These Terms & Conditions (“Terms”) govern your access to and use of this Shopify ecommerce website, products, and services provided by Aussie Nails and Fasteners Warehouse (“we”, “us”, “our”). By accessing or purchasing from our store, you agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.

Eligibility & Account

  • You must be at least 18 years old or the age of majority in your jurisdiction to make purchases.
  • Account holders are responsible for maintaining the confidentiality of login credentials and for all activities that occur under the account.
  • Provide accurate, current, and complete information; keep it up to date.

Products, Descriptions & Availability

We make reasonable efforts to display accurate product descriptions, specifications, and availability. However, minor variations (e.g., colour, finish, packaging) may occur. We reserve the right to limit quantities, discontinue items, or change specifications without notice.

Trade users: Please verify technical suitability before purchase. Contact us for guidance on nail guns, fasteners, and construction tools.

Pricing, Taxes & Payment

  • Prices are displayed in AUD and may include or exclude taxes as indicated at checkout.
  • We may correct pricing errors and cancel orders with incorrect pricing before dispatch.
  • Accepted payment methods are shown at checkout and processed by secure, PCI-compliant payment gateways. We do not store full card numbers.
  • Orders are only accepted once payment is authorised and you receive an order confirmation email.

Orders, Acceptance & Cancellation

Your order is an offer to purchase. We may accept or decline any order (or part) for reasons including limited stock, suspected fraud, pricing error, or delivery restrictions. If we cancel after payment, we will refund the amount paid for the cancelled item(s).

Shipping, Delivery & Risk

  • Shipping options, costs, and estimated timelines are provided at checkout.
  • Risk of loss passes to you upon delivery to the address provided or upon collection from a carrier/pickup location as applicable.
  • Please inspect deliveries on arrival. Report visible damage within 48 hours with photos.

Returns, Exchanges & Refunds

We want you to be satisfied with your purchase. Our policy is as follows:

  • Used products are non-returnable and non-refundable. Items that have been opened, tested, installed, or modified are not eligible.
  • Only unused, unopened, and original condition items may be returned within 14 days of delivery, with all packaging and accessories intact.
  • Return shipping is the customer’s responsibility unless the item is confirmed faulty or we made an error.
  • Refunds (where approved after inspection) are processed to the original payment method within 7–10 business days.

Warranty

Tools generally carry a 12-month warranty on parts, excluding normal wear items (e.g., piston/driver blades, belts, piston stops, isolators, bumpers, O-rings). Components found defective due to materials or workmanship within the warranty period will be repaired or replaced at no charge. Warranty is void if misused, deliberately damaged, or used with non-genuine consumables.

Reviews, User Content & Conduct

  • You may post reviews and questions where available, provided content is lawful, accurate, and not misleading, defamatory, or infringing.
  • By submitting content, you grant us a non-exclusive, royalty-free licence to use and display it on our store and marketing channels.
  • We may remove content violating these Terms or applicable laws.

Intellectual Property

All content on this site—text, graphics, logos, icons, images, product data, audio/video clips, downloads, and software—is our property or that of our licensors and protected by applicable IP laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission.

Prohibited Uses

  • Illegal activities, infringement, or violating others’ rights.
  • Introducing malware, scraping, or interfering with security features.
  • False orders, fraudulent returns, or misuse of promotions.

Our store uses third-party apps and services (e.g., Shopify, carriers, analytics, marketing). Their terms and privacy practices apply when you interact with those services. We are not responsible for third-party websites or resources.

Promotions, Coupons & Gift Cards

  • Promotions and coupons are subject to separate terms including dates, eligible items, and limits.
  • Gift cards are redeemable only on our store and are non-refundable except as required by law.

Disclaimers & Limitation of Liability

Except as required by law, the website and all products/services are provided “as is” and “as available.” We disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from your use of the site or products.

Our total aggregate liability for any claim relating to a purchase shall not exceed the amount you paid for the product(s) at issue.

Indemnification

You agree to indemnify and hold harmless Aussie Nails and Fasteners Warehouse and our officers, employees, and agents from any claim, demand, losses, or expenses (including legal fees) arising from your breach of these Terms or misuse of the site.

Force Majeure

These Terms are governed by the laws of Australia. Courts located in Australia (state/territory determined by our principal place of business) will have non-exclusive jurisdiction. Where applicable laws require, you may have rights to alternative dispute resolution or to bring claims in your local courts.
